A judge ruled prosecutors may use the recorded interview. The state says Davis later repeated key details publicly, outside any protected proffer.
Prosecutors say the shooting was retaliation after Shakur and others attacked Davis’s nephew Orlando Anderson hours earlier.
Grand-jury witness Terrence Lee attributed an account to DeAndre Smith: Davis passed a pistol toward Anderson before Smith allegedly took it.
Police recovered electronics, ammunition, photographs, clippings and an old hotel-related receipt. Public reporting has not tied a recovered murder weapon to Davis.
No publicly identified gun, DNA, fingerprint or other forensic evidence places Davis in the Cadillac or connects him directly to the bullets.
The defense says Davis embellished stories for money and notoriety. Jurors will have to decide whether his public accounts are reliable admissions.
Davis argues earlier cooperation was protected. Courts rejected dismissal, while the scope and effect of the agreement remain central to the defense narrative.
Three other alleged Cadillac occupants are dead. The delay limits cross-examination and makes memories, retellings and hearsay harder to test.
Some accounts name Orlando Anderson; grand-jury testimony pointed to DeAndre Smith. The state need not prove Davis pulled the trigger, but the conflict tests the story’s reliability.
